Medical Malpractice Cases in MD

Our Hagerstown Lawyers Are Here to Protect Your Rights

FAQ | Contact Us | Give Us a Call

We trust our physicians and medical practitioners to make correct decisions when we come to them for care, and often these split-second decisions are the difference between successful treatment and devastating injuries.

While every medical mistake does not result in a medical malpractice lawsuit, if you suspect a negligent or careless error resulted in a serious physical injury, our Hagerstown medical malpractice attorneys can help you or your family discover if you are entitled to financial compensation.

In addition to mistakes made by the medical professional themselves, serious physical injuries could also result from:

  • Hospital negligence
  • Surgical errors
  • Anesthesia problems
  • Prescriptions errors

What is the Statute of Limitations on Medical Malpractice?

Medical Malpractice Statute of Limitations: West Virginia

According to West Virginia Code section 55-7B-4, medical malpractice claims must be started within two years of the date of the injury OR within two years of the date when the injury was discovered. Relying on the "discovery rule" however, is not recommended.

If you file a claim two years after an injury was discovered, you are required to prove that the injury was not immediately apparent and was indeed discovered later.

It's also important to know that if an injury is discovered after the fact, if the event that caused the injury occurred more than ten years ago, no matter how serious the injury is, you no longer have the legal right to file a medical malpractice claim.

Medical Malpractice Statute of Limitations: Maryland

According to Maryland Code section 5-109, medical malpractice claims must be started within five years from the time the injury was committed or three years from the date the injury was discovered.

What Do Medical Malpractice Attorneys Do?

Medical malpractice attorneys play a crucial role in advocating for individuals who have suffered injuries due to medical negligence or error. They work diligently to assemble the evidence necessary to demonstrate that a healthcare provider's actions or omissions were not in line with the standard of care expected in the medical community, thereby leading to the patient's injuries. These legal professionals possess a comprehensive understanding of both law and medicine, enabling them to navigate the complex interplay between these disciplines and secure just compensation for their clients.

Services offered by top medical malpractice lawyers in Maryland include:

  • Comprehensive case evaluation to determine the viability of a medical malpractice claim.
  • Gathering and analyzing medical records, expert witness testimonies, and any other evidence pertinent to the case.
  • Negotiating with insurance companies and opposing counsel to secure the best possible compensation for the client.
  • Representing the client in court if a fair settlement cannot be reached.
  • Ensuring that all paperwork and legal documents are filed correctly and within the Maryland medical malpractice statute of limitations.
  • Providing advice and support to clients throughout the legal process, ensuring they are informed of their rights and the progress of their case.
