What is the Statute of Limitations on Medical Malpractice?

Medical Malpractice Statute of Limitations: West Virginia

According to West Virginia Code section 55-7B-4, medical malpractice claims must be started within two years of the date of the injury OR within two years of the date when the injury was discovered. Relying on the "discovery rule" however, is not recommended.

If you file a claim two years after an injury was discovered, you are required to prove that the injury was not immediately apparent and was indeed discovered later.

It's also important to know that if an injury is discovered after the fact, if the event that caused the injury occurred more than ten years ago, no matter how serious the injury is, you no longer have the legal right to file a medical malpractice claim.

Medical Malpractice Statute of Limitations: Maryland

According to Maryland Code section 5-109, medical malpractice claims must be started within five years from the time the injury was committed or three years from the date the injury was discovered.
